Listing Terms for Providers
This is a translation for reference. In the event of any discrepancy, the Japanese version shall prevail.
These Listing Terms (the "Terms") apply to businesses and individuals (the "Listing Parties") that list information on schools, housing, SIM cards, insurance, banks, credit cards, scholarships, jobs, tours, homestays, events, and the like on BLOOM ABROAD (the "Service"), operated by BLOOM CONSULTING ("we" or "us").
1. Scope of Listings and Review
- Listings are limited to content that we have reviewed and judged suitable for listing. We decide whether, when, where, and in what order to list.
- Listing Parties represent that they are real businesses or individuals and that they have authority over the information they list. For verification, we may ask them to submit a corporate number, business registration number, license number, or the like.
- We distinguish free listings from advertising and paid placements (Advertising Terms and Disclosure Policy). The ranking and evaluation of free listings do not change depending on whether advertising fees, referral fees, or listing fees are paid.
2. Responsibilities of Listing Parties (Accurate Information)
- Listing Parties shall keep fees, periods, conditions, locations, contact details, and the like accurate and up to date, and shall promptly notify us of any change.
- Exaggerated expressions, unsupported superlatives or comparisons, and information that differs from the facts may not be listed. We may correct or remove expressions that we cannot verify.
- Listing Parties shall provide only content and photographs that do not infringe the rights of third parties (copyrights, portrait rights, trademarks, etc.). Where photographs are provided, Listing Parties grant us a free license, for the period of the listing, to use them, including by listing, translating, summarizing, and resizing.
3. Our Editing and Display
- We may summarize, translate, and format information provided by Listing Parties for readability. We will confirm with the Listing Party any correction that changes the meaning.
- We do not describe Listing Parties with words such as "official" or "supervised." Where necessary, we use only words that state facts (such as "information cooperation" or "interview cooperation").
- Listings for which we receive advertising fees or referral fees carry a "PR" or "Ad" label and a disclosure that Users can understand.
4. Inquiries and Personal Information
- We may pass inquiries from Users to Listing Parties after obtaining the User's consent. Listing Parties shall use the personal information they receive only for the purpose of responding to that inquiry, and shall manage it in accordance with laws and regulations.
- Listing Parties shall not provide that personal information to third parties, or use it for sales contact, without the User's consent.
5. Changing, Suspending, and Ending a Listing
- Listing Parties may request a change to or suspension of a listing at any time. We will respond within a reasonable period.
- In the following cases, we may suspend or delete a listing without prior notice: when the content differs from the facts, when there is a serious complaint from a User, when there is a violation of laws or regulations or of these Terms, or when we are unable to reach the Listing Party.
- We are not liable for damages arising from the suspension or deletion of a listing, except where we act with willful misconduct or gross negligence.
6. Disclaimer and Results
- We do not guarantee results of a listing, such as inquiries, contracts, or sales.
- Contracts, transactions, and disputes between Listing Parties and Users shall be resolved between the parties concerned.
7. Fees
Free listings are free of charge. Advertising and paid placements are subject to separate inquiry, the Advertising Terms, and individual agreement. These Terms do not set out fees, performance-based rewards, or exclusivity conditions.
8. Governing Law and Jurisdiction
- These Terms are governed by the laws of Japan.
- If a dispute arises in connection with the Service, the district court having jurisdiction over our location shall be the exclusive agreed court of first instance. However, where the Consumer Contract Act or other mandatory consumer protection laws provide otherwise, those provisions apply.
9. Language
The Japanese version of these Terms is the authoritative text. Versions in other languages are reference translations, and in the event of any inconsistency, the Japanese version prevails.
